The Council on Ethical and Judicial Affairs of the American Medical Association examines physicians’ professional ethical responsibility in the event that the security of patients’ electronic records is breached.

Although informed consent is important in clinical research, questions persist regarding when it is necessary, what it requires, and how it should be obtained. The standard view in research ethics is that the function of informed consent is to respect individual autonomy. However, consent processes are multidimensional and serve other ethical functions as well. These functions deserve particular attention when barriers to consent exist. We argue that consent serves seven ethically important and conceptually distinct functions. The first four functions pertain (...) principally to individual participants: (1) providing transparency; (2) allowing control and authorization; (3) promoting concordance with participants' values; and (4) protecting and promoting welfare interests. Three other functions are systemic or policy focused: (5) promoting trust; (6) satisfying regulatory requirements; and (7) promoting integrity in research. Reframing consent around these functions can guide approaches to consent that are context sensitive and that maximize achievable goals. (shrink)

A total of 1918 loci, detected by the hybridization of 938 expressed sequence tag unigenes from 26 Triticeae cDNA libraries, were mapped to wheat homoeologous group 4 chromosomes using a set of deletion, ditelosomic, and nulli-tetrasomic lines. The 1918 EST loci were not distributed uniformly among the three group 4 chromosomes; 41, 28, and 31% mapped to chromosomes 4A, 4B, and 4D, respectively. This pattern is in contrast to the cumulative results of EST mapping in all homoeologous groups, as reported (...) elsewhere, that found the highest proportion of loci mapped to the B genome. Sixty-five percent of these 1918 loci mapped to the long arms of homoeologous group 4 chromosomes, while 35% mapped to the short arms. The distal regions of chromosome arms showed higher numbers of loci than the proximal regions, with the exception of 4DL. This study confirmed the complex structure of chromosome 4A that contains two reciprocal translocations and two inversions, previously identified. An additional inversion in the centromeric region of 4A was revealed. A consensus map for homoeologous group 4 was developed from 119 ESTs unique to group 4. Forty-nine percent of these ESTs were found to be homoologous to sequences on rice chromosome 3, 12% had matches with sequences on other rice chromosomes, and 39% had no matches with rice sequences at all. Limited homology was found between wheat ESTs on homoeologous group 4 and the Arabidopsis genome. Forty-two percent of the homoeologous group 4 ESTs could be classified into functional categories on the basis of blastX searches against all protein databases. (shrink)

Thirty-two years ago W. V. Quine proposed a definition of 'logical truth' that has been widely repeated and reprinted. Quine himself seems to have recognized that this definition is wrong in detail; in section 1 we eliminate this fault. What has perhaps been less widely observed is that, in abandoning the model-theoretic account of logical truth in favor of a "substitutional" account, Quine's definition swells the ranks of the logical truths and makes the classification of a sentence as a logical (...) truth dependent both on the interpretation of its extralogical words and on the extralogical vocabulary available in the language. I dispute the claim that the disclosure of the life-world by phenomenology is an accomplishment of 'permanent' significance. By briefly reviewing the meaning of the "world" and "life-world" in the writings of Husserl, Gurwitsch, Schutz-Luckmann, Ortega, Heidegger, Jonas, Straus, Sartre and Merleau-Ponty, I show that they all treat the world, or rather the affairs which comprise it, as passively present whether viewed as a mental acquisition or as the "Other." But the meaning of the world-as that wherein are met physical (...) demands upon us which must be satisfied if we are to continue living-cannot be considered either as a mental acquisition or as something that is "other" and over against us. A living being as living cannot fail to attend to the agency of the affairs of which the life-world consists, as well as one's own exploring and coping actions. If we are to really speak of life, then we must acknowledge the mutual and reciprocal activities of living beings and world. (shrink)

The difficulties of undertaking good quality effectiveness research in palliative medicine are well documented. Much of the ethical literature in this area focuses on the vulnerability of the palliative care population. It is clear that a wider ethical approach will need to be used to justify research in the terminally ill. Some themes of ethical thought are underutilised in considering the ethics of palliative care research. Three arguments to justify the need for effectiveness research in palliative care should be highlighted: (...) there is evidence of an untapped altruism amongst the population of palliative care patients who would be keen to be involved in such research; traditional Aristotelean and Thomistic virtue ethics would point to the need to gain knowledge in and of itself, but especially in palliative medicine for the benefit of patients: virtue also accrues in the acquisition of a stock of research experience which in turn makes further research feasible; most compellingly, justice would dictate that palliative treatments are effective, that futile or useless treatments are avoided and that patients are not party to “n of 1” trials by default. The current state of the evidence base of effectiveness in palliative care leads us to the uncomfortable position where patients are in precisely the position of being unwitting participants in “n of 1” clinical trials by default, without their explicit consent. In the October 1937 number of Philosophy of Science Lindsay has made certain criticisms of the adequacy of the “operational method” of analyzing and giving meaning to the concepts of physics, documenting his criticisms chiefly from my own writings. In these criticisms he has made statements as to the method which I would by no means accept. This is not characteristic of his paper only, for I have seldom indeed seen a printed discussion of the method which I would accept (...) as being an adequate or sometimes even fair representation of what I understand by it. It will perhaps pay therefore if I attempt to state what I conceive it to be all about, particularly since I have never attempted such a comprehensive statement and since my own ideas on the subject have been developing since I first wrote in the Logic of Modern Physics. For one reason I have hesitated to do this, for fear of seeming to subscribe to the not uncommon idea that we are dealing with some elaborate and profound new theory of the nature of knowledge or of meaning. I believe that I myself have never talked of “operationalism” or “operationism”, but I have a distaste for these grandiloquent words which imply something more philosophic and esoteric than the simple thing that I see. What we are here concerned with is an observation and description of methods which at least some physicists had already, perhaps unconsciously, adopted and found successful—the practise of the methods already existed. What I have attempted is to analyze these successful methods, not to set up a philosophical system and a theory of the properties that any method must have if it hopes to be successful. Since I was concerned with a technique already extant, my principal method of getting others to see what the technique involved has been to exhibit examples of the technique in action, rather than to attempt any exhaustive characterization of the technique itself.
